Terms and Conditions

Welcome to Giga Brain Limited. These Terms of Service (“Terms”) govern your use of our website and services (collectively, the “Service”), including the swapping of $TRAC tokens for access to the Ecosystem Validator Pool. By using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our Service.

1. Eligibility

1.1 Jurisdictional Restrictions

Our Service is not available to residents of the United States, China, Canada, Hong Kong, and any other UN sanctioned country. By using our Service, you represent and warrant that you are not located in any of these countries and that your use of our Service does not violate any applicable laws or regulations in your jurisdiction. Any resident of these countries trying to participate in the validator pre-sale will be subject to reimbursement.

1.2 No Account Required

Users are not required to create an account to use our Service. The Service is accessible directly via our website, subject to acceptance of these Terms.

1.3 Age Requirement

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you meet this age requirement. Or the Legal age of your country of residency.

2. Supported Wallets and Tokens

2.1 Supported Wallets

The supported wallets for the $TRAC token swap are Unisat, XVerse, Leather, and OKX Wallet. It is the user’s responsibility to ensure compatibility with these wallets before using the Service.

2.2 Token Information

The Service involves the transfer of BRC-20 $TRAC tokens to our deposit wallet. Users must ensure that they are transferring the correct token type. Any other asset deposited or any amount superior to the deposited amount displayed on the website will not be subject to refund and be considered lost.

2.3 Verification

Before transferring tokens, users must verify the deposit address provided by the Company. The Company is not responsible for tokens sent to an incorrect address due to user mistake.

3. Service Description

3.1 Deposit Process

Users will receive a unique deposit address after they have read, understood, and accepted these Terms and the detailed instructions provided on our website. Users must manually send the predetermined amount of $TRAC tokens to the provided deposit address using their supported wallet.

3.2 Validator License Inscription

By depositing the predetermined amount of $TRAC tokens, users will be eligible to receive a Validator License Inscription at a later point in time (under 24 months). The Company reserves the right to decide the timing and the method of issuance of these licenses. Once issued, users will be able to inscribe their Validator License.

3.3 Validator Node Operation

With the Validator License Inscription, users will have the capability to run their own validator node once the validator system is live. Operating a validator node will enable users to earn rewards from the network.

3.4 Fees

Users are responsible for any Bitcoin gas fees incurred during the transfer of $TRAC tokens. These fees are determined by the Bitcoin network and are not controlled by the Company.

3.5 Transaction Confirmation

Users must confirm that their transaction has been successfully completed by verifying the transaction on the blockchain. The Company is not responsible for incomplete or failed transactions.

3.6 No Guarantee of Rewards

While the Validator License allows users to operate a validator node, the Company does not guarantee any specific rewards or returns. The rewards are dependent on the network's performance and other external factors beyond the Company's control.

4. User Responsibilities

4.1 Accuracy of Transfers

Users are solely responsible for ensuring the accuracy of their token transfers. This includes verifying the correct deposit address, token type, and transaction amount. The Company is not liable for any errors made by users, including but not limited to incorrect deposit amounts or sending tokens to the wrong address.

4.2 Compliance

Users must comply with all applicable laws and regulations when using our Service. This includes ensuring that their use of the Service does not violate any local, state, or national laws.

4.3 Understanding Risks

Users acknowledge that engaging in cryptocurrency transactions involves inherent risks, including market volatility, technological issues, and regulatory changes. Users agree to assume all such risks.

4.4 Security Measures

Users must implement appropriate security measures to protect their wallets and private keys. The Company is not responsible for any loss or theft resulting from inadequate security measures on the user’s part.

5. Liability and Disclaimers

5.1 No Liability

The Company is not liable for any loss or damage arising from the use of our Service. This includes, but is not limited to, losses or damages resulting from user errors, technical issues, third-party actions, or market fluctuations.

5.2 Refund Policy

Users may request a refund within seven (7) days of their deposit. Refund requests made after this period will not be honored. Refunds are subject to the user providing proof of the original transaction and completing any necessary verification steps as required by the Company, including but not limited to KYC or KYB action if suspected to reside in a country not allowed in the service.

5.3 Third-Party Services

The Company is not responsible for any third-party services or products linked to or advertised on our website. Users should review the terms and conditions of any third-party services before use.

5.4 Disclaimer of Warranties

The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Privacy Policy

6.1 No Data Collection

We do not store any user information. Users are advised to keep their transaction details and other personal information secure.

6.2 Third-Party Data

Any data collected by third-party services or wallets is subject to their respective privacy policies. Users should review these policies before using such services.

7. Miscellaneous

7.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Cayman Islands, without regard to its conflict of law principles.

7.2 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the Service constitutes acceptance of the revised Terms. It is your responsibility to review the Terms periodically for updates.

7.3 Dispute Resolution

Any disputes arising out of or in connection with these Terms or the Service shall be resolved in accordance with the laws of the Cayman Islands.
